Update from Domingo Castillo @ U.S Department of Labor Wage & Hour Division

I want to share the following updates under the FLSA.

The New Overtime Rule went into effect on January 1, 2020, additional information can be found here https://www.dol.gov/agencies/whd/overtime/2019/index.

The Regular Rate Final Rule went into effect on January 15, 2020.  To gain guidance in determining the regular rate click here https://www.dol.gov/agencies/whd/overtime/2019-regular-rate.

And lastly, Joint Employment Status update will go into effect on March 16, 2020.  For more information on the rule click here https://www.dol.gov/newsroom/releases/whd/whd20200112.

Fact sheets for these topics and other topics (Hours Worked, Employment Relationship, Break Time for Nursing Mothers, Child Labor, etc.) can be found here https://www.dol.gov/agencies/whd/fact-sheets.

And lastly, https://www.youthrules.gov/ which provides a wealth of information about the employment of minors.  The hours minors can and cannot work depending on their age, and what kind of work/occupation they are permitted to engage in, again depending on their age.  I always encourage employers and parents to visit the page to be informed of rules as they apply to their potential employee and/or child.  Summer will soon be here and I am certain some youth under 18 will want to work.

I hope the information will be of value to the Ft. Worth APA members, if I can be of service in providing or presenting compliance information to SHRM members please do not hesitate in reaching out.

Respectfully,

Domingo Y. Castillo
